OUR 1st INDOOR CONCERT FUNDRAISER FOR L.C.M.F. WAS AN AMAZING TIME & A SMALL SUCCESS! WINTER FEST 2016 HELPED US RAISE ENOUGH MONEY FOR LORAIN COUNTY MUSIC FEST TO FILE OUR INITIAL ARTICLES OF INCORPORATION FOR A NOT FOR PROFIT ORGANIZATION & RECEIVED OUR ACCEPTANCE JULY 22nd JUST BEFORE LO.CO. MUSIC FEST 9!
END OF JULY 2016: we were approached on our property, while OUR volunteer group was making posters for Music Fest 9, by the zoning inspector for Graftom Township Tom Steigerweld, he informed us, rather rudely, that we could not do what we were doing? We informed him, that we we're a nonprofit organization, functioning on a business zoned property and why is there a problem? He kept quoting from things that we felt didn’t apply to us as we were led to believe. He came back the morning of the start of festival, With the Township trustees, Tom Magnon the Lorain county prosecutor, health department officials, fire department, and in a very intimidating manner, and without any filed complaints from citizens or otherwise, Inspected our property. We have never had an issue in the Past. They said that they wouldn’t stop the festival this time? We asked why would they want to stop us? Why would there be an issue to hold event, since we had met all the requirements, & filed with/notified the proper agencies, as we always have in the past and per the health department, & Sherrif's dept. etc. we were clear? We had already received a temporary camping permit, They couldn’t give us an answer. So we all discussed and agreed to meeting with the trustee board later, and we carried on and had our festival as normal on our future property.
UPDATE AUGUST 2016:
LO. CO. MUSIC FEST 10 WAS AUGUST 5TH - 7TH 2016. OUR 10 YEAR ANNIVERSARY WAS AMAZING, NOT ONLY DID WE RECEIVE OUR NOT FOR PROFIT STATUS AS ACCEPTED JULY 22nd WE ALSO DREW ABOUT 500 PEOPLE, IT WAS AN AMAZING EVENT, ONE OF OUR BEST! WE HAD MANY PERFORMERS & GOOD TIMES! THANK YOU EVERYONE FOR YOUR LOVE & SUPPORT! WE WILL CONTINUE TO WORK TOWARDS BUILDING THE KID'S ROCK DAY CAMP & MORE!
On Sat night, we allowed Steigerweld and others access to our property To observe it during festival hours. Because we have nothing to hide. Then surprisingly very early Sunday morning, while most of our staff & guests were slumbering & just a few of our overnight staff were watching, Steigerweld entered our property WITHOUT INVITE, through a gate that was closed and toured the campgrounds in his vehicle, which is against our posted rules, taking pictures without permission or informing us.
WE DISCOVERED THAT THERE IS NO ORDINANCE FOR SPECIAL EVENTS/OUTDOOR MUSIC EVENTS IN GRAFTON TWP. USUALLY THERE IS AN ORDINANCE FOR SPECIAL EVENTS WITH A PERMIT FEE. WE FOUND OUT BY RECEIVING A CEASE & DESIST ORDER FROM TOM STEIGERWELD: GRAFTON TWP, ZONING INSPECTOR ON AUG 11th. WE WERE TAKEN QUITE ABACK BY SUCH A HOSTILE MOVE WHEN WE HAD YET TO EVEN MEET WITH THE BOARD.
AUG 11th Leading up to AUG 17th:
Director Joseph J. Rocha made many calls to Inspector, Trustees and Prosecutor Magnan, without answer FROM ANYONE. Then sent an e-mail to the Trustees, in an attempt to try and talk to trustees & prosecutor and see what we need to do to abide them and come to a peaceable agreement.
WE CALLED UNTIL FINALLY REACHING TWP. & COUNTY PROSECUTOR TOM MAGNAN (ONLY TOOK ABOUT 2 WEEKS) & SCHEDULED A MEETING WITH TRUSTEES, FOR AUG 22nd WHERE WE DISCUSSED, WITH LANDLORD PRESENT, OUR PLANS & GAVE COPY OF PROPERTY, FESTIVAL LAYOUT, 501c3 NOT FOR PROFIT STATUS & ORDINANCE AMENDMENT DRAFT, BUT NEEDED TO SUBMIT IT WITH A $500 APPLICATION FEE! WE INFORMED THEM WE WOULD NEED TIME TO RAISE THE MONEY. WE ALSO INFORMED THEM OF OUR RED'S MEMORIAL MUSIC FEST COMING UP IN SEPT. WHICH THEY SAID THEY WOULD NOT HAVE A PROBLEM WITH SINCE IT WAS A FAMILY REUNION.
SEPT 16th -18th WE HELD REUNION WITHOUT ISSUE OR COMPLAINT.
BEGINNING OF 2017:
OUR 2nd FUNDRAISER WAS AGAIN AN AMAZING TIME & ANOTHER SMALL SUCCESS! WINTER FEST 2017 HELPED US RAISE ENOUGH THAT WE FINISHED PUTTING THE MONEY DOWN ON THE PROPERTY & THE MONEY FOR THE FILING FEE TO AMEND ZONING ORDINANCE FOR GRAFTON TWP. AS WELL, WE HOPED TO HAVE EVERYTHING ACCEPTED BY SECOND WEEK OF MAY.
MARCH 2017 UPDATE:
WE REACHED OUR GOAL & PUT THE MONEY DOWN ON THE PROPERTY!! THANK YOU TO OUR SPONSOR FOR LOANING THE LAST AMOUNT ON DOWNPAYMENT & THANK YOU TO ALL OUR SUPPORTERS & MUSIC FAMILY FOR HELPING US JUMP THE HURDLE OF RAISING THE $500 FOR AMENDMENT! WE SUBMITTED OUR AMENDMENT DRAFT WITH FEE TO GRAFTON TOWNSHIP.

ZONING MEETING TO SEE WHAT TO ANTICIPATE FOR THE AMENDMENT MEETING (THIS WAS NOT A SET APPOINTMENT) THEY ADDRESSED OUR SUBMITTED AMENDMENT & WE WERE TOLD THAT THIS MAY TAKE A WHILE & WE INFORMED THEM THAT WE WANT TO WORK WITH THEM, (despite their already unfounded aggressive behavior) AND HOPEFULLY IT COULD BE RESOLVED BY LO.CO. MUSIC FEST IN AUGUST, OUR BIGGEST FUNDRAISER EVENT & THAT WE WOULD HOST MONGO AS A PRIVATE EVENT, SO WE COULD COMPLY & CONTINUE TO PREPARE FOR LO.CO. AS WE'VE BEEN DOING FOR 5 SEASONS, WHICH THEY DID NOT SAY ANYTHING ABOUT.

WE RECEIVED A CERTIFIED LETTER NOTICE - WENT TO POST OFFICE TO FIND ANOTHER CEASE & DESIST ORDER FROM TOM STEIGERWELD.

TOM S. APPEARED AT OUR DOOR THE WITH THE COUNTY PROSECUTOR TOM MANGAN TO TELL US NOT TO HAVE AN EVENT AND GIVE WARNINGS FOR VIOLATIONS?! (This seemed very aggressive due to the fact that he KNEW we received the C & D by the certified letter notice) WE MADE MORE POSTS ON OUR PAGES & UPDATED EVENT TO INFORM THAT WE WERE CHANGING LOCATION OF MONGO.
THEN FRI APRIL 28th
TOM S. FILED A PERMANENT INJUNCTION, USING OUR PAGES OLDER FB POSTS, NOT SHOWING OUR LOCATION CHANGES, TO OBTAIN INJUNCTION, TO KEEP US FROM HAVING ANY MUSIC EVENTS OR ANY SIMILAR EVENT ON OUR PROPERTY OR IN THE ENTIRE TOWNSHIP OF GRAFTON!! EVEN A PRIVATE PARTY!? WE FEEL WE MUST POINT OUT THAT WE DID NOT DEFY THE C & D ORDER. IT WAS FILED ON AUG. 10TH -- LO.CO. WAS HELD ON AUG 5TH. WE HELD NO OTHER EVENTS ON PROPERTY, BUT OUR RED'S REUNION, WHICH THEY AGREED WAS ACCEPTABLE AT AUG. 22nd MEETING??!! WE WERE ALREADY MOVING THE MONGO EVENT - MUCH TO OUR DISCOMFORT - & HOPING OUR SUPPORTERS STAYED TUNED FOR OUR NEW LOCATION! -

UPON CONTACTING LO. CO. SHERIFF'S OFFICE WE FOUND THERE ARE NO COMPLAINTS ON OUR PROPERTY OR AREA FOR SOUND OR ANYTHING ELSE FOR THE ENTIRE YEAR! THEN WE DISCOVERED THAT OF THE THREE NEIGHBORS BEHIND US ARE; ONE IS CHAIRMAN ON THE ZONING BOARD & ONE IS CHAIRMAN ON THE APPEAL ZONING BOARD! AND ANOTHER IS A TRUSTEE! (Now wondering if this has anything to do with the fact that we're being dealt with so severely?)
AFTERNOON OF TUES MAY 9th:
THE NEW RUSSIA TWP. (OBERLIN) ZONING INSPECTOR NOTIFIED ART & CATHY COTE THE OWNERS OF PROPERTY WE'VE HOSTED FESTIVALS AT FOR THE PAST 3 SEASONS whom offered us the use of their property for Mongo, WE CANNOT HOLD EVENT THERE!!! WHEN ASKED FOR SPECIAL EVENT PERMIT, IT WAS DENIED. REASON GIVEN WAS NO ZONING ORDINANCE FOR IT. WTF? This was not an issue before. WHY NOW?
AFTERNOON OF WED MAY 10th:
WE GRACIOUSLY RECEIVED AN OFFER OF PROPERTY TO USE IN NORTH RIDGEVILLE, BY GIBBY.
AFTERNOON FRI MAY 12th:
WE APPLIED FOR AND WERE GRANTED A TEMPORARY CAMPING PERMIT FOR GIBBY'S PROPERTY.
AFTERNOON TUES MAY 16th
WE WERE TOLD BY NORTH RIDGEVILLE, CAN'T DO IT AT GIBBY'S. REASON GIVEN WAS NO ZONING ORDINANCE FOR IT. WHEN WE CONTACTED MAYORS OFFICE & ASKED FOR SPECIAL EVENT PERMIT, IT WAS DENIED. (Since when has MUSIC become so ostracized???)
MORNING OF TUES MAY 16th:
HAD A HEARING FOR THE PERMANENT INJUNCTION, WE ACCEPTED (Although against our will) A PERMANENT INJUNCTION AGAINST US HAVING ANY EVENTS OR SIMILAR ON OUR PROPERTY, INSTEAD OF ALL OF GRAFTON TWP. UNTIL ORDINANCE AMENDMENT IS ACCEPTED! After court, I approached Carl Wesemyer and my landlord Cheri, whom looked pretty uncomfortable as he had cornered her and kept asking her questions, that her reply to was: "I don't know you should/would have to ask Geri." I politely intervened by putting out my hand and saying; "Hi Carl, I'm Geri Ciacchi founder of L.C.M.F. Cheri doesn't have the answers to what your asking her, but I could probably help you." He AGGRESSIVELY responded by raising his voice saying: "I'm not talking to you. I'm talking to Cheri." then continued to ignore me NO MATTER HOW CALMLY I TRIED to talk to him he kept escalating his voice then CROSSED HIS ARMS AND TURNED AWAY FROM AND WHILE HE FACED THE WALL-- "YELLED I'M NOT TALKING TO YOU!" wow this is our trustee whom I've only just met, never did anything to anyone and he won't even acknowledge me, but you represent me and my trust?! There was also a just-met-at-court-neighbor (neighbor that lives directly behind us and became a trustee in 2020?) who ACCUSED me of lying about how long I've lived in Grafton Twp. This my statement of "If there's anything you want to know you can just ask me." We're 100% transparent. Honey -- News Flash --- Doesn't matter how long I've/we've/you've been here --- 20 years or 20 minutes --- I'M A RESIDENT TOO!

WE ATTENDED GRAFTON TWP. HALL MEETING/HEARING WITH NEIGHBORS, LANDLORD, & A GROUP OF SUPPORTERS AS WELL AS REPRESENTATIVES FROM THE JAILHOUSE TAVERNE. AND WE EXPLAINED & APOLOGIZED FOR OUR DEFENSIVENESS, THAT THIS WAS DUE TO TRUSTEE WESEMYER, NEIGHBOR DOWDELLS, ZONING APPELLATE CHAIRMAN FRED GEISE & INSPECTOR TOM STEIGERWELD'S COLECTIVE & CONTINUAL AGGRESSIVE BEHAVIOR TOWARDS US. ESPECIALLY AFTER WESEMYER'S CHILDISH BEHAVIOR IN COURTROOM EARLY THAT SAME DAY! WE WENT OVER AMENDMENT AND DISCUSSED THAT WE WOULD NEED TO SIGN ADJUST AND RE SUBMIT APPLICATION AGAIN.

Summer thru Fall of 2017:
We kept all our events on other properties, much to our dismay, still, since moving our events around severely cuts our attendance. We took our donations from Lo.Co. Music Fest 11 and applied them to our lawyer who started the process for us to change our name from Lorain County Music Fest, and re-submit our Non Profit under new name Lorain County Music Foundation. The trustees revised a new Noise Resolution which pretty much targets the Jailhouse Tavern so they could slap violations on them, WHICH THEY DID, and charged their Cook and Partner John!
The court date was set in Nov and has been continued. We'll see what happens.
SEPTEMBER 2017:
OUR NEW NAME WAS ACCEPTED & OUR NOT FOR PROFIT 501C3 IS RECOGNIZED BY THE STATE! We received our charter member # and tax EIN. We are now LORAIN COUNTY MUSIC FOUNDATION. (Fests, are what we host, NOT who we are!)
Early Nov 2017:
WE received our Tax Exempt Status! Now we can work on Grants etc. We just have to learn how . . . .
Later Nov 2017:
More articles about the ongoing "Battle" by Scott at the Chronicle. Then there were ads in the Rural Urban (Grafton Paper) for the elections and re elections of trustee's, along with comments on recently opened Facebook page by running trustee John Kasinek. The Jailhouse placed ads in the Rural Urban and FaceBook also -- POSTING what they believed to be going on with OUR TRUSTEES WESEMYER, KASINEK & Steigerweld. These led to some very interesting comments on John K's new page that was only started in Sept. (just in time for elections) Foremost being: JOHN IF YOU'RE A TRUSTEE FOR THE WELFARE OF THE PEOPLE OF OUR TWP. WHY DID IT TAKE YOU SO LONG TO REACH OUT TO US? LMFAO. These & many comments were followed up and dissected by locals and others to reveal that he primed his page and comments by having HIS OWN FAMILY MEMBERS THAT DID NOT RESIDE IN THE TWP. Commending him on a job well done etc. Very sad. He was voted out and Christie Miller was voted in.

NOT TOO SURPRISING, BUT: SURPRIZE: JOHN K. SUDDENLY APPEARS ON THE BOARD FOR ZONING. Sigh . . .
Feb 2018:
The Jailhouse Tavern Partners & lawyer asked for a special meeting with Trustees and met on 7th.
FEB 2018:
THE ZONING BOARD PASSED OUR AMENDMENT. NOW IT IS TRANSFERRING TO THE TRUSTEES!
We would like to, but we do not feel confident "these" specific trustees and their "cronies" will let it pass. Newest member of Zoning Board John K. was only one to vote NO on our amendment. Still feeling salty, eh?
MARCH 3rd 2018:
Was our 3rd annual Winter Fest Concert Fundraiser! Thank you all for your help by attending & donating, purchasing raffle item or donating at door and event! so again: THANK YOU FOR YOUR TIME & CONTINUING SUPPORT! WE RAISED ENOUGH TO PAY THE $300 AMENDMENT APPEAL SUBMISSION FEE WHEN/IF WE NEED TO & POSSIBLY BUILD ONTO STAGE ETC.
UPDATE MARCH 14th 2018:
THE MEETING GOT INTERESTING WHEN Fred Geise get VERY UPSET and came halfway out of his seat when I asked if anyone in the room knew what a Decibel was. (Yes, I'm sorry I might have asked that slightly sarcastically) And again WHEN I merely proposed doing a run thru Decibel Reading on a Live Band at Jailhouse and/or our yard, to document levels realistically. I'm still a little shocked at the close mindedness. I have been in music for awhile and we've all been researching the decibels of lawnmowers, motorcycles, live bands, people talking etc. When I quoted what these and OUR decibel levels were. A whole round of people started saying: "yeah right! No way! And; how do you know?" When I informed them it's scientific fact THEY can look it up THEY REFUSED TO BELIEVE ME! PROSECUTOR MAGNAN LOOKED AT ME AND SHOWED A DECIBEL METER ON HIS PHONE & CHECKED THE ROOM & IT READ WHAT I SAID THE LEVEL PROBABLY WAS: 60 TO 70 Dc. I quoted from a KNOWN DECIBEL CHART ONLINE! WOW! DON'T LET SCIENCE PROVE IT, GO RIGHT ON AHEAD WITH YOUR UNREALISTIC EXPECTATIONS ON NOISE IN OUR TOWNSHIP! Please do NOTICE I said OUR TWP. --- because we have a RIGHT to do what we WANT, too --- JUST LIKE YOU --- in OUR Twp. We just DON'T FORCE OUR WAY ONTO OTHERS, nor do we have the money or political influence to back us or PUSH what WE WANT thru your "elected board". BUT in November 2018 we can pass a petition and we're pretty confident it WILL go thru, since we ONLY NEED 8% of our supporting residents to sign it.
Our problem: MOST of our raised monies lately, have gone towards our expenses, including lawyer fees. Which removes our funding for events! We never anticipated a complete road block for 3 seasons on all our endeavors.
BUT! WE WILL KEEP GOING & WE ARE READY TO APPEAL, if/when they give their negative decision. We hope to keep fundraising so we can continue ahead with our plans for our dated events, internships, school music programs and hopefully Kids Rock Day Camp.
